PLEASE TAKE NOTICE that the Town of North Wilkesboro (hereinafter the “Town”) has received an offer for the purchase of certain real property owned by the Town as described in Exhibit “A,” incorporated herein, and proposes to sell the same pursuant to the provisions of G.S. §160A-269.  Said property is situated in North Wilkesboro Township, Wilkes County, North Carolina, and is more particularly referred to as follows:





BEING all of Lot 11 of Block 35 of Trogdon’s Map of North Wilkesboro found in Plat Book 1 Page 36; bounded to the north by a 20’ wide alley; west by other property of Town of North Wilkesboro found in Deed Book 1221 Page 334 Parcel 1; south by Main Street; west by Shepherd Real Estate, LLC found in Deed Book 1059 Page 324 with bearings oriented to said Trogdon’s Map and distances taken from a survey by Scott Church Land Surveying, PLLC in September 2017 and more particularly described as follows:

BEGINNING on a PK nail set at the northern right of way for Main Street, the southeastern corner of Lot 13 of Block 35 of Trogdon’s Map of North Wilkesboro (Plat Book 1 Page 36), said PK nail being located North 62° 33’ 08” East, 250.00’ from an iron pin found with cap at the intersection of the northern right of way for said Main Street with the eastern right of way for Tenth Street.

Thence leaving said Main Street, with the eastern line of Lot 13; Shepherd Real Estate, LLC (Deed Book 1059 Page 324), North 27° 27’ 00” West, 140.00’ to a PK nail set at the southern right of way for a 20’ wide alley, said PK nail being located South 57° 04’ 07” West, 210.01’ from a lead plug found and said PK nail being located North 62° 33’ 07” East, 250.00’ from a PK nail found.

Thence with the right of way for said 20’ wide alley, North 62° 33’ 00” East, 25.00’ to a point in the lid of a water meter serving subject property, the northwestern corner of Lot 9 of said Block 35, being other property of North Wilkesboro (Parcel 1 Deed Book 1221 Page 334).

Thence with said Lot 9, South 27° 27’ 00” East, 140.00’ to a point at the mortar joint dividing Lot 9 and Lot 11 at the northern right of way for Main Street.

Thence with the northern right of way for Main Street, South 62° 33’ 00” West, 25.00’ to the POINT OF BEGINNING.

Said property contains 3,500 square feet by coordinate calculations.

Reference: All of Parcel 2 of Deed Book 1221 Page 334.

Property is located in North Wilkesboro Township, Town of North Wilkesboro, Wilkes County, North Carolina.

BEING the same property described as Parcel 2, as conveyed by 906 Main Street, LLC, by deed to the Town of North Wilkesboro, dated February 2, 2016, and recorded in Deed Book 01221, Page 0334, and Wilkes County Registry. The property is also referred to as 912 Main Street.

The Town has received an upset bid from Gabriel Miller, 605 Coffey Avenue, North Wilkesboro, NC  28659 of Fifty-One Thousand, Three Hundred Twenty-Seven Dollars and Fifty-Six Cents. ($51,327.56). Within ten (10) days of the date hereunder any person may raise said offer by filing an upset bid in writing, stating the amount of the new offer and the name and address of the offeror.  The upset bid shall be in an amount no less than Fifty-Three Thousand Nine Hundred Forty-Three Dollars and Ninety-Four Cents ($53,943.94).  All subsequent upset bids shall be no less than ten (10%) percent of the first one thousand ($1,000.00) dollars and five (5%) percent of the remainder. Upset bids shall be delivered in writing to the Town Clerk, Debra W. Pearson, Post Office Box 218, 832 Main Street, NC 28659, no later than 5:00 P.M. on April 26, 2019, and shall be accompanied by a deposit in the amount of FIVE (5%) PERCENT of the new offer in cash, or by certified or personal check made payable to the Town of North Wilkesboro. Upset bids, if mailed, must be received in the office of the Town Clerk, on or before the above stated date.  In the event more than one upset bid is filed, the first upset bid received shall govern and all subsequent upset bids received shall be returned to their respective bidders.  Upon receipt of an upset bid in compliance with the foregoing provisions, the property will be advertised again for additional upset bids, under the same procedure as set forth above, which procedure shall continue until no further upset bid has been received.

Upon the completion of all required upset bid periods the final offer received will be presented to the North Wilkesboro Board of Commissioners, which may accept the offer or reject the same. In the event the offer is accepted, closing on the same must take place within thirty (30) days of said acceptance.
