NOTICE OF SALE

NORTH CAROLINA, WILKES COUNTY, IN THE GENERAL COURT OF JUSTICE, DISTRICT COURT DIVISION, FILE NO. 19 CVD 787, WILKES COUNTY, Plaintiff, vs. JOHNNY LEE FINANDIS and wife, FELICA CASE FINANDIS, Defendants.

TAKE NOTICE that, under and by virtue of an order of the District Court of Wilkes County, North Carolina, made and entered in the above captioned matter, the undersigned Commissioner will on the 15th day of October, 2019, offer for sale and sell for cash, to the last and highest bidder at public auction, at the door of the Wilkes County Courthouse, 500 Courthouse Drive, Wilkesboro, North Carolina, at 10:00 a.m., the following described real property, lying and being in Union Township, Wilkes County, North Carolina, and being more particularly described in the Exhibit “A” attached hereto.

“EXHIBIT A”

BEING all of Tract #4, containing 1.031 acres, as shown and described on a Map of Montana View, Phase 1, Mountain Resource Company, said map being made by Lewis N. Cox, Registered Land surveyor, and recorded in Map Book 9, Page 202, Wilkes County Registry.

The above-described property is prohibited against the placement of single-wide mobile homes on said property.

Subject to the Right-of-Way for SR-1567 (Sheets Gap Road).

Subject to any and all matters set forth on the Map of Montana View, Phase 1, Mountain Resource Company recorded in Map Book 9 at Page 202, Wilkes County Registry.

Subject to all service and utility easements of record, N.C. Highway Commission easements and rights of way of record, and all matters revealed by a current and accurate survey.

BEING the same property as conveyed by Mountain Highlands, Inc., a North Carolina corporation, to Johnny Lee Finandis, by deed dated the 15th day of May, 2000, and recorded in Deed Book 840, Page 158, Wilkes County Registry.

This sale will be made subject to all outstanding city and county property taxes, if applicable, and all local improvement assessments, if applicable, against the above described real property not included in the judgment in this action.

A deposit of five percent (5%) of the successful bid will be required.
