NOTICE OF SALE
NORTH CAROLINA, WILKES COUNTY, IN THE GENERAL COURT OF JUSTICE, DISTRICT COURT DIVISION, FILE NO. 16 CVD 911, WILKES COUNTY, Plaintiff, vs. ROBERT EARL MCNEIL and wife, MRS. ROBERT EARL MCNEIL; and VERGIE ELISE MCNEIL, Single; Defendants.
TAKE NOTICE that, under and by virtue of an order of the District Court of Wilkes County, North Carolina, made and entered in the above captioned matter, the undersigned Commissioner will on the 11th day of February, 2020, offer for sale and sell for cash, to the last and highest bidder at public auction, at the door of the Wilkes County Courthouse, 500 Courthouse Drive, Wilkesboro, North Carolina, at 10:00 A.M., the following described real property, lying and being in Rock Creek Township, Wilkes County, North Carolina, and being more particularly described in the Exhibit “A” attached hereto.
BEGINNING on an iron in the Right of Way of (Villa Street) SR-2361, said being the Southeast corner of Lot 3, of Villa Heights Subdivision, THENCE with said Street Right of Way, South 26° 31’ 05” West 100.35 feet to an iron in said Right of Way, THENCE with Lot 5, North 63° 20’ 00” West 263.43 feet to an iron, THENCE North 00° 11’ 49” East 111.87 feet to an iron, THENCE with Lots 1, 2, and 3, South 63° 22’ 19” East 313.03 feet to the BEGINNING, containing 28,897 square feet, more or less by Coordinate Computation.
For further reference see Lot 4, Block A, Villa Heights Subdivision, as recorded in Plat Book 7, Page 92 and Deed Book 584, Page 156, and Deed Book 704, Page 496, Wilkes County Registry. Surveyed by Jerry R. Lackey, RLS L-1430, June, 1992, Wilkesboro, N.C.
The above described tract is conveyed and accepted subject to the restrictions for Villa Heights Subdivision as the same are recorded in Book 532, Page 025, Wilkes County Registry.
Subject to the right-of-way for S.R. No. 2361 (Villa Heights Drive).
Subject to all service and utility easements of record, N.C. Highway Commission easements and rights of way of record, and all matters revealed by a current and accurate survey.
BEING the same property as conveyed by Wilma Prevette to Robert Earl McNeil and wife, Vergie McNeil, by deed dated January 5, 2001, and recorded in Deed Book 850 Page 415, Wilkes County Registry.
This sale will be made subject to all outstanding city and county property taxes, if applicable, and all local improvement assessments, if applicable, against the above described real property not included in the judgment in this action.
A deposit of five percent (5%) of the successful bid will be required.
