NOTICE OF SALE
NORTH CAROLINA, WILKES COUNTY, IN THE GENERAL COURT OF JUSTICE, DISTRICT COURT DIVISION, FILE NO. 18 CVD 1061, WILKES COUNTY, Plaintiff, vs. LINDA S. LAWS aka LINDA LAWS MASHBURN, Single; and TIMOTHY B. JOINES, Guardian Ad Litem For LINDA S. LAWS aka LINDA LAWS MASHBURN, Single; Defendants.
TAKE NOTICE that, under and by virtue of an order of the District Court of Wilkes County, North Carolina, made and entered in the above captioned matter, the undersigned Commissioner will on the 11th day of February, 2020, offer for sale and sell for cash, to the last and highest bidder at public auction, at the door of the Wilkes County Courthouse, 500 Courthouse Drive, Wilkesboro, North Carolina, at 10:15 A.M., the following described real property, lying and being in Reddies River Township, Wilkes County, North Carolina, and being more particularly described in the Exhibit “A” attached hereto.
BEGINNING at an iron stake located North 82° West 115.05 feet from Control Corner Monument No. 786 and located in the Northern margin of East Green Crest and running with the Northern margin of East Green Crest, North 82° West 115 feet to an iron stake; thence North 9° 25’ East 168.47 feet to an iron stake; thence South 82° 55’ East 115.06 feet to an iron stake; thence South 9° 25’ West 170.32 feet to the point of beginning, containing .45 of an acre, more or less, and being Lot 5 in Block A of Green Acres, Section III, as shown on the Map recorded in Map Book 7, Page 2, Wilkes County Registry.
The above described land is conveyed subject to the following restrictions:
1. The property shall be used as residential purposes only.
2. No residence shall be built containing less than 1,000 square feet living space.
3. No house trailers shall be located thereon for living purposes.
4. No buildings shall be constructed using concrete blocks showing above ground level.
5. No livestock or poultry shall be kept on the property with the exception of household pets.
6. The terrace ditch running along the back of Lots 1 through 5 of Block A in Section III shall remain open and shall not be closed by anyone.

Subject to all service and utility easements of record, N.C. Highway Commission easements and rights of way of record, and all matters revealed by a current and accurate survey.
BEING the same property as conveyed by J. Gary Vannoy, Executor of the Estate of William E. Bouchelle, Jr., Deceased, (78 E 232, Wilkes County Clerk of Court) to Linda S. Laws by deed dated July 3, 1979, and recorded in Deed Book 576, Page 451, Wilkes County Registry.
This sale will be made subject to all outstanding city and county property taxes, if applicable, and all local improvement assessments, if applicable, against the above described real property not included in the judgment in this action.
A deposit of five percent (5%) of the successful bid will be required.
