UNDER AND BY VIRTUE of the authority contained in a certain Order entered by the Honorable Carla S. Royal, Assistant Clerk of Superior Court for the County of Wilkes on the 30th day of December, 2019, in a special proceeding therein entitled “In the Matter of the Estate of Pauline Rhodes McLean, Robert G. Greene, Jr., Administrator,” designated as 19 SP 188, the undersigned Commissioner will on Friday, March 20, 2020, at 10:00 a.m., on the steps of the Wilkes County Courthouse, offer for sale to the highest bidder for cash, those certain three (3) tracts or parcels of land, with same being located at 908 Hill Avenue, Wilkesboro, North Carolina 28697, as is more particularly described in Deed Book 602, Page 312, Deed Book 384, Page 121, and Deed Book 362, Page 528 of the Wilkes County Registry, bearing Wilkes Tax ID Parcel #2202340; and Hill Street, Wilkesboro, North Carolina 28697, as is more particularly described in Deed Book 602, Page 312, Deed Book 566, Page 620 and Deed Book 566, Page 631 of the Wilkes County Registry, bearing Wilkes Tax ID Parcel #2202336; and Curtis Bridge Road, Wilkesboro, North Carolina 28697, as is more particularly described in Deed Book 602, Page 312, Deed Book 566, Page 620, and Deed Book 566, Page 621 of the Wilkes County Registry, bearing Wilkes Tax ID Parcel #2202337, respectively and being further described as follows:

TRACT 1:

908 HILL AVENUE, WILKESBORO, N.C. 28697 (PARCEL ID 2202340):

Lots 5, 6, 7, and 8, in the plat section “G” out of the Nancy W. Hoyle development on Hill Avenue, and joined on the East by Mrs. T.M. Foster, and on the West by lot No.9, now owned by Nancy Wellborn Hoyle, and on the North by George Kennedy development.

For further reference see plat in Plat Book No.2 at page 44, in the Register of Deed office in Wilkes County.

Also, being a strip of land 20 feet wide and extending along the entire Eastern side of Lot 9, Section G of the Nancy Wellborn Hoyle Subdivision as shown on map recorded in Map Book 2, Page 44 office of the Wilkes County Registry. It is the intent of this deed for the grantors herein to convey 20 feet off of the Eastern side of the said lot and extending along the entire Eastern side and adjoining Lot 8 and to retain for themselves, their heirs and assigns the remainder of said lot.

TRACT 2:

HILL STREET, WILKESBORO, N.C. 28697 (PARCEL ID 2202336):

BEING all of Lot Numbers 1, 2, 3 and 4 of Section G as more specifically described by the plat of the Wellborn Addition to the Town of Wilkesboro, as recorded in the Office of the Register of Deeds for Wilkes County in Map Book 2, Page 44, Wilkes County Registry.

Subject to the Rights-of-Way for SR-1185 (Curtis Bridge Road) and SR-1792 (Hill Avenue).

Subject to all service and utility easements of record, N.C. Highway Commission easements and rights of way of record, and all matters revealed by a current and accurate survey.

BEING the same property as conveyed by J.T. McLean, to Pauline R. McLean, by deed dated January 15, 1982, recorded in Deed Book 602, Page 312, Wilkes County Registry. Pauline R. McLean died in Wilkes County, North Carolina, on March 4, 2019. See File 19 E 373, Office of the Wilkes County Clerk of Superior Court.

TRACT 3:

CURTIS BRIDGE ROAD, WILKESBORO, N.C. (PARCEL ID 2202337)

BEING all of Lot Numbers 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22 and 23 of Section C, as more specifically described by the plat of the Wellborn Addition to the Town of Wilkesboro, as recorded in the Office of the Register of Deeds for Wilkes County in Map Book 2, Page 44, Wilkes County Registry.

Subject to the Rights-of-Way for SR-1185 (Curtis Bridge Road) and SR-1792 (Hill Avenue).

Subject to all service and utility easements of record, N.C. Highway Commission easements and rights of way of record, and all matters revealed by a current and accurate survey.

BEING the same property as conveyed by J.T. McLean, to Pauline R. McLean, by deed dated January 15, 1982, recorded in Deed Book 602, Page 312, Wilkes County Registry. Pauline R. McLean died in Wilkes County, North Carolina, on March 4, 2019. See File 19 E 373, Office of the Wilkes County Clerk of Superior Court.

This conveyance is made subject to all easements and restrictions, if any, of record.

This sale is subject to all ad valorem taxes and such other liens and encumbrances as may appear of record.

1. The property to be offered pursuant to this Notice of Sale is being offered for sale, transfer and conveyance “AS IS, WHERE IS.” The Commissioner makes no representations or warranties relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property being offered for sale, and any and all responsibilities or liabilities arising out of or in any way relating to any such condition expressly are disclaimed. This sale is made subject to all prior liens and encumbrances, and unpaid taxes and assessments.

2. The successful (highest) bidder shall be required to make a cash deposit at the time of sale in the amount of 5% of the highest bid or $750.00, whichever is greater. Any successful bidder shall be required to tender the full balance of the purchase price so bid, in cash or certified check, at the time the undersigned Commissioner tenders, or attempts to tender, to the successful bidder, a deed for the property. Should the successful bidder fail to pay the full balance of the purchase price so bid at that time, the successful bidder shall remain liable on the bid as by law provided.

3. This sale shall be held open ten (10) days for upset bids as by law provided.

4. This sale is made pursuant to Chapter 1, Article 29A of the North Carolina General Statutes.

5. The successful bidder’s inability to secure a loan for the balance of the sale proceeds is not an excuse to void the sale/purchase.
