NOTICE OF INTENT TO APPROVE LEASE AGREEMENT
PLEASE TAKE NOTICE that the County of Wilkes (hereinafter the “County”), through action of its Board of Commissioners and upon the recommendation of the Wilkes County Airport Board, pursuant to North Carolina General Statutes 153A-176, 160A-272, and 63-53(3), proposes to enter into a Lease Agreement (hereinafter the “Agreement”) with Samaritan’s Purse for the lease of certain real property at the Wilkes County Airport. The Agreement contains, but is not limited to, the following terms:
1-DESCRIPTION OF PROPERTY TO BE LEASED: The Agreement is for the lease of a tract of approximately 2.331 acres of ground space on the west side and northern end of the runway at the Wilkes County Airport, said tract being the location of a new hangar building and other improvements currently under construction by Samaritan’s Purse adjacent to that tract which is the subject of a Lease Agreement between the County and Samaritan’s Purse dated August 1, 2014, and recorded in Book 1194, Page 405, Wilkes County Registry (hereinafter the “2014 Lease Agreement”). The tract to be leased to Samaritan’s Purse under the Agreement, which would include a portion of the tract described under the 2014 Lease Agreement, is shown and depicted on that plat to be attached as Exhibit “A” to the Agreement and is more fully described in Exhibit “B” to the Agreement (said tract is hereinafter referred to as the “leased premises”). Under the terms of the Agreement, the 2014 Lease Agreement would be cancelled.
2. AMOUNT AND TERMS OF OFFER: Samaritan’s Purse proposes to lease the above described property from the County for a period of twenty (20) years with three (3) five-year renewal options. Rental to be paid by Samaritan’s Purse will be $423.07 per month for the first five (5) years of the initial twenty (20) year term, $490.45 per month for the next five (5) years of the initial twenty (20) year term, $568.57 per month for the next five (5) years of the initial twenty (20) year term, $659.13 per month for the next five (5) years of the initial twenty (20) year term, $764.11 per month for the first renewal term, $885.81 per month for the second renewal term, and $1,026.90 per month for the third renewal term.
THE PUBLIC MAY OBTAIN COPIES OF THE PROPOSED LEASE AGREEMENT BY CONTACTING THE OFFICE OF ANTHONY R. TRIPLETT, WILKES COUNTY ATTORNEY, AT (336) 667-7201, BETWEEN THE HOURS OF 8:30 A.M. AND 5:30 P.M. MONDAY THROUGH THURSDAY AND BETWEEN THE HOURS OF 8:30 A.M. AND 4:00 P.M. ON FRIDAYS, FROM THE DATE OF THIS NOTICE THROUGH MONDAY, AUGUST 3, 2020.
Within ten (10) days of the date of this Notice, through and including Monday, August 3, 2020, at 5:00 o’clock p.m., any person may file an upset bid with regard to the lease terms proposed as set forth above. Any such upset bid shall propose an increase in the annual rental amount as set forth above, to be paid to the County of Wilkes, said increase being no less than ten percent (10%) of the first one thousand and no/100 dollars ($1,000.00) and five percent (5%) of the remainder of said annual rental amount. Said upset bid shall further propose to comply with all of the remaining terms and conditions of the Lease Agreement as proposed for Samaritan’s Purse. All upset bids shall be filed in writing with Anthony R. Triplett, Wilkes County Attorney, Post Office Box 1388, 922 C Street, North Wilkesboro, North Carolina 28659, by mailing the same to said address, and shall include a cash deposit of five percent (5%) of the amount of the upset bid. Upset bids which do not comply with the provisions of this Notice, or which are received by Anthony R. Triplett, Wilkes County Attorney, later than 5:00 o’clock p.m. on Monday, August 3, 2020, shall not be valid and shall not be considered by the County of Wilkes.
Should no upset bid be filed, the Wilkes County Board of Commissioners hereby gives notice that it intends to officially authorize and approve the Lease Agreement with Samaritan’s Purse at its regular meeting of Tuesday, August 4, 2020.
