NOTICE OF INTENT BY WILKES COUNTY TO APPROVE SUBLEASE

PLEASE TAKE NOTICE that the Wilkes County Board of Commissioners (hereinafter the “Board of Commissioners”), pursuant to North Carolina General Statutes 153A-176 and 160A-272, proposes to enter into a Sublease Agreement with Wilkes County Remote Control Car Club, of Wilkes County, North Carolina (hereinafter “Sublessee”), for the sublease of certain real property owned by ECMD, Inc., and leased by Wilkes County (hereinafter the “County”).  Said Sublease Agreement contains, but is not limited to, the following terms:

1.    DESCRIPTION OF PROPERTY TO BE SUBLEASED.  The Sublease Agreement is for the sublease of the following described real property:

Being a portion of that 89.885 acre tract located in the Town of Wilkesboro, Wilkesboro Township, Wilkes County, North Carolina, said tract being owned by ECMD, Inc., f/k/a/ East Coast Millwork Distributors, Inc., and being leased to the County under that Lease Agreement dated December 1, 1994, and recorded at Book 737, Page 870, Wilkes County Registry.  Said tract is currently operated by the County as a park and recreational facility under the name “Lowe’s Park at River’s Edge.”  The portion to be subleased by the County to Sublessee is located on the western end of Lowe’s Park at River’s Edge and is bounded on the south by the former runway for the old Wilkes County Airport, on the west by the eastern edge of the existing tree line (as of the date of the Sublease Agreement) between the subleased premises and the new Wilkes YMCA, on the north by a curving boundary as shown on Exhibit “A” which is to be attached to said Sublease Agreement and which at its closest point is thirty (30) feet from the Yadkin River Greenway trail, and on the east by a ditch line and that line as shown on said Exhibit “A.”

2.    AMOUNT AND TERMS OF OFFER.  Sublessee proposes to sublease the above described property from the County, and the County proposes to sublease the same to Sublessee, for a term of three (3) years, commencing as of September 1, 2019, and expiring on August 31, 2022.  The Sublessee will not be required to pay rent but will be required to comply with certain obligations as set forth in the Sublease Agreement concerning its operations on the subleased premises.  The Sublease Agreement shall further provide that Sublessee’s use of the property shall be exclusively for the operation and racing of remote control cars by Sublessee.  

FURTHER TAKE NOTICE that the Wilkes County Board of Commissioners intends to authorize and approve the above described Sublease Agreement at its next regular meeting occurring thirty (30) or more days after the date of this Notice in the Commissioners’ Room at the Wilkes County Office Building in Wilkesboro, North Carolina.
